How Long Do I Have to Pursue a Personal Injury Claim in Florida?
In Florida, the deadline for filing a personal injury claim has recently undergone a significant change. For most personal injury lawsuits based on negligence, including those arising from automobile accidents (including those involving trucks, motorcycles, bicycles, and pedestrians), slip and falls, and other injury-causing incidents that occurred on or after March 24, 2023, the statute of limitations is now two years from the date of the accident. This is a considerable reduction from the previous four-year deadline that applied to these claims.
If your accident happened before March 24, 2023, the older four-year rule may still apply. Additionally, if you tragically lost a loved one because of negligence, the statute of limitations for a wrongful death claim is usually two years from the date of the victim’s passing, which isn’t always the date of the accident or incident itself.
